In a recent turn of events, the Harbor District has drawn significant criticism for its handling of bylaws revisions and alleged violations of California’s Brown Act, which mandates the public agencies to provide 72 hours notice with agendas and supporting materials. Harbor Commissioner, Annie Nehmer’s  approach has raised concerns, with some believing she disregards the transparency requirements outlined in the law due to inconsistent changes causing delay in providing public documents.

Further fueling the discontent is the discrepancy between the bylaws presented to the public 3 weeks ago and the version now posted for the commissioner’s vote. Critics argue that the public- reviewed bylaws have been significantly altered without adequate notice or explanation. Additionally, the existing bylaws, approved by previous board members and still technically in effect, are reportedly being ignored altogether.

Harbormaster Rademaker defended the changes, likening the process of creating new bylaws to a president repealing executive orders. However, this comparison has done little to assuage concerns.

The new bylaws are being criticized for inconsistencies, alleged first amendment violations, and an apparent shift of legal authority from the board to the harbormaster. One particularly contentious issue is the harbor’s policy on prayer invocations, potentially opening the harbor to public scrutiny and legal challenges.

“This is the recipe for lawsuits”,  one  community member stated, voicing concerns about the harbor’s vulnerability to litigation stemming from both procedural and constitutional issues.

The Harbor District’s actions have left many questioning to its commitment to transparency, accountability, and respect for established laws. As the fallout  continues, the district could face not only public backlash but also potential legal repercussions.
