One of the primary focuses of our Association is to spare taxpayers dollars by prevention of unnecessary lawsuits against our local public entities.

It has come to our attention that the Board of the Solid Waste Management Authority (SWMA) intends to discuss the Grand Jury matter in his absence despite that your Board Member, Roger Gitlin, clearly made himself available for the August 18, 2015 board meeting.

The Grand Jury report does not extend any authority for the Board of SWMA to deprive Board Member Gitlin of the normal course of process which would provide Board Member Gitlin the right to refute, deny or explain any allegations or intended actions that the Board intends to entertain including agenda items 5.3 (and 5.4).

It is our position that discussing matters that pertain to Board Member Gitlin when the Board is aware of his absence would deprive a number of protected rights.

Please take notice that we expect item 5.3 be pulled from the meeting of July 21st either until the August 18th meeting or until the setting of a Special meeting.

It is the consensus of our Board that this be done.
