Why doesn’t Prosecution handle cases diligently?

In November 2009 Pelican Bay State Prison filed Charges with the District Attorney Office on Inmate Danny Roman C-15546, and seized his inmate account of $26,004.00.

In April 2010, District Attorney, Mike Riese, filed a petition for Asset Forfeiture, however, Mr. Roman was not served a notice of seizure until March 2010.

On February 7, 2011 Danny Roman filed an answer to petition for Asset forfeiture, then filed an opposition to strike answer and claim on April 11, 2011 in response to plaintiff’s motion to strike answer.

In June 2011 a defendant Danny Roman filed a motion to return property with supporting points and authorities, and drafted a request for production of documents, which was served on plaintiff District Attorney Office.

The DA’s office responded and served Mr. Roman with those responses on September 2, 2011. Since September 2, 2011 defendant Roman was not served with any requests for discovery, notice of motions, or hearings or any further information regarding the matter by Del Norte Superior Court or District Attorney’s office.

The California Code of Civil Procedure was the biscuit that broke the District Attorney’s office Back under California Code of Civil Procedure 583.360 (a) provides that an action shall be dismissed by the court on it’s own motion or on motion of the defendant after notice to the parties, if the action is not brought to trial within 5 years of commencement. (b) the requirements of this article are mandatory and not subject to extension, excuse or exception.

On May 29, 2015, Inmate Danny Roman’s attorney, Gabriel Zendejas Chavez, filed an motion Dismissing Civil Forfeiture Action for Failure to prosecute which was signed by a Del Norte Superior Judge.

How did this happen? Inmate Roman had been to court several times and on June 15, 2012 he made a request for council to Assistant District Attorney Specchio, which she informed him he not entitled.

Is that what happened in the Lacy Case?

Is this what will happen in the Joey Young Case?

    It’s like that Lay’s potato chip commercial, “Bet you can’t eat just one”
    In my case it is Bet you can’t think of just one illegal, abusive, corrupt, horrendous
    event” in Del Norte County.

What if the game is “Life In Del Norte County” The citizens are given an illusion of a ball and they have their life skills. Good luck. YOU NEED TO KNOW THE GAME IS TO HAVE ALL EXPENSES, PAID FOR BY THE UNKNOWING CITIZENS, GRANT MONEY, STEAL YOUR MONEY, AND ANYTHING OF VALUE, AND GET YOU HOMELESS AND OUT OF TOWN BEFORE YOU CAN BE WITNESSES
    TO THE EMBEZZLEMENT OF MILLIONS OF DOLLARS OF GRANT MONEY, USING JOINT POWERS, DOUBLE TALK AND AMENDMENTS. MANY PEOPLE HAVE CAUGHT ON TO THE MANY FRAUDULENT LEADERS AND THE GAME COULD BE CHANGING. IF THEY CANNOT GET YOU OUT OF TOWN (HAS ANYONE HEARD ANY OF THE SUPERVISORS COMPLAINING OF THE LOSS OF JOBS FROM CRITICAL ACCESS?) THEY, THE SO CALLED LEADERS, RETIRE AND MOVE.
    THE OUT OF TOWNERS buy a property to raise their family and find out their hospital job is gone.(SUPERVISORS WE CAN’T HEAR YOU) SO you call one of the many jobs listed in the ads. Only to find there are no jobs, only an ILLUSION. Being short of money you cannot afford their sewer bill. Unemployment starts next month, you’ll catch it then. You have plenty of yard to raise chickens and a creek. Now you find there is a toxic dump 500 feet from your well that was on the National Priority List. The law says you must disclose any toxic areas to buyers of real estate. You check out attorneys and find out
    Grey didn’t even show up to trial, leaving his own client in legal disaster. And surely you cannot get a building permit next to a Toxic Area with all the departments that have to sign their names and date the Negative Declaration. Jim Barnst, Hemmingson, and Finnigan are quick to claim A NEGATIVE DECLARATION for any self serving, public project paid for with a CDBG grant. These grants are given to provide jobs for unemployed and under employed citizens. There is a PRETEND MEETING WHERE CITIZENS PROVIDE INPUT and the City Council or Board of Supervisors state there was no public interest so they get the grant and do what ever they want with the hundreds of thousands of dollars. Then when somebody embezzles the money the accused are paid while on administrative leave. Hemmingson can’t understand the big deal. The head of the Probation department was going to put it back, it wasn’t that much. It was for gambling. What did happen to that guy? Does Anybody know? Or the Young Felon whose many, many felonies for embezzling his
    clients premiums was reduced to a misdemeanor by the infamous Judge Morrison. The judge punished Officer (Pelican Bay) YOUNG with Community Service”perhaps he could “coach little league” so says the judge. OOps sewer bill is due and your bill is now attached to your property tax. Next will be the foreclosure and auction of your home. I asked Bob Black, City Atty, also HARBOR, AIRPORT, FIRST FIVE, AND ??? I do not think he lists the departments individually. Check out his mandatory conflict of interest form. Anyway, I asked if the council and supervisors would be allowed to bid on peoples foreclosed house? Yes! Why wouldn’t they. Because they know how many jobs there are, and can end jobs (like Michelle Rambo) by declaring not enough funds (as they give out MERIT PAY INCREASES). Then they pick up a house by watching the bids. Interesting philosophical theory, but it would not stand up in law. The other trick they do is cancel the auction
    if somebody is bidding more than they want to pay!

    This government is an illusion. It may have the appearance of candidates voted on and elected by the people and the few times that happened, (Donna Westfall)anytime she proposed an idea it was denied 4 to 1. When she attempted to follow the sewer plants $43 million dollar

    TERM LIMITS and VIDEO THE PLANNING COMMISSION, THE COMMUNITY DEVELOPMENT, SCHOOL BOARD HARBOR,LAFCO,TRANSPORTATION MEETINGS. YOU WILL SEE THE SAME FACES AT EVERY SINGLE MEETING. OOPS! OOPS! FORGOT THE AIRPORT. ASK FOR A TREASURY REPORT AT EACH MEETING.
    THOSE THREE THINGS SHOULD DO IT: TERM LIMITS, VIDEO TAPED MEETINGS AND TREASURY REPORT.
    It’s OUR ONLY HOPE.
